Absztrakt
The paper focuses on the regulation of the requirement of equal treatment and the institutions that ensure its implementation. The European Union's Race and Gender Directives made it compulsory for Member States and candidate countries to set up equality bodies. While this was a huge step towards ensuring protection against discrimination, but the current EU legislation focuses exclusively on tackling discrimination based on certain characteristics (gender, race, and ethnicity). To date, 47 equality bodies are members of the European Network of Equality Bodies (Equinet), which vary considerably in terms of their mandate, litigation functions, etc. In my research, I characterized the 47 bodies according to various aspects, like supervisory bodies, and then conducted a survey on their decision-making and sanctioning powers. The background to my empirical research is the institutional and legislative context in Hungary with the delegation of the powers of the Equal Treatment Authority to the Office of the Commissioner for Fundamental Rights. I was curious whether Equinet's participating bodies had a similar solution. I illustrate the empirical research results with diagrams in the paper.
