Absztrakt

The present paper analyses the admissibility criteria “unconstitutionalism affecting the judicial decision and question of utmost constitutional importance” in the practice of the Constitutional Court. The paper argues that the Constitutional Court uses these criteria in a hectic way and often for the purpose of dismissing application in the admissibility stage instead of dealing with them on the merits. The paper also argues that the related practice of the Constitutional Court is not in line with – in some aspects it is clearly against – of the jurisprudence of the ECHR.
